Delaware media is reporting the Delaware Supreme Court just overturned the conviction of Trinity Carr in the death of Amy Joyner-Francis.  The student died as a result of injuries sustained in a beating at Howard High School on April 24th, 2016.  The full decision is embedded below.

WDEL reports:

The Supreme Court on Thursday said no reasonable factfinder could have found that the girl acted with criminal negligence or, even if she did, that it would be unjust to blame her for Joyner-Francis’ death given how unforeseeable it was that the fight would lead to a young teen dying of cardiac arrest.

To read the full legal opinion, issued today, please read below.  Due to the fact many involved in the case were minors, the Delaware Family Court changed the names of minors.  The appeal is written on behalf of “Tracy Cannon”.  But there is no mistaking this.  It is Trinity Carr.  Amy Joyner-Francis’ name is “Alcee Johnson-Franklin”.  Being that this case was so heavily publicized, I feel it is a dishonor to the memory of Amy Joyner-Francis to change her name.  It belittles her and points her as something different than the victim of a horrific murder.  I’m sorry, but this was murder.  It may not have been intentional, but a student died.  And it would have never happened if Carr didn’t go into that bathroom with the intention of causing harm to Amy.

This is what happens when justice dies in the first state to sign the Constitution.  Those who pimp out 16 and 17 year olds for human sex trafficking get probation.  Special education diagnosticians who have sex with students get probation.  And now, murderers get away with murder.

  1. CARR’S SMUG LOOK ON HER FACE SHOWS HER REMORSE OVER MURDERING THAT POOR GIRL. WHAT HAS OUR JUSTICE SYSTEM TURNED INTO. THAT WAS MURDER PLAIN AND SIMPLE. MY HEART GOES OUT TO AMY’S PARENTS WHO HAVE TO WATCH THE PERSON WHO MURDERED THEIR DAUGHTER LIVE A LONG FULL HAPPY LIFE. THERE IS NO JUSTICE IN THIS WORLD ANYMORE.
    I GUESS WE CAN TAKE SOME PIECE IN KNOWING SHE WILL HAVE TO ANSWER TO OUR LORD SOMEDAY FOR HER EVIL SINS.

  3. Yes Delaware’s judicial system definitely needs a do over. I don’t understand how they let really bad ppl walk n first time offenders spend years in jail for non violent crimes. And if you try and tell the uppers that the system isn’t working they just say what you wanna hear. They don’t care.

  4. I don’t understand the justice’s application of the law to the fact pattern. I would argue that death as a result of a fight, unknown medical condition or not, was absolutely proximate to the cause of action. Any reasonable person would assume that death could result from fighting, especially one premediated where the court did not overturn the conspiracy charge. I pray that Amy’s family files one hell of a wrongful death suit and is awarded a windfall. Though they likely will never see it, Carr will spend her life being hunted by creditors, judicial actions, liens, etc. May she never forget that the court has blindly shown her more justice than she ever did her victim.

  5. Delaware Supreme Court is as bad as CA. There an illegal immigrant, deported 5-7 times, Felon, shot and killed a woman walking on the boardwalk. Gets off free and clear. Here, girl walked into bathroom, put her hands on another girl and caused her death. It seems lately the ppl DOING the assaulting are the innocent ones and the ones BEING assaulted are the ones at fault, yet their the ones that end up dead. This is completely backwards of how it is SUPPOSE to be. Only thing we can do is PRAY this Country turns it’s self around. Need to restore respect, kindness, and compassion to our fellow citizens. PRAY
