School-Based Health Centers Proposal May Collide With Parental Authority… This Is A Game Changer In Schools!

I’ve heard constant echoes of one thing over the past year: we need more supports in our schools for our high-needs students.  But what happens when that call is heard but we may get far more than we ever bargained for?  What if the services provided become very invasive in scope?

The Delaware Department of Health and Social Services (DHSS) put out a request for proposal (RFP) for all nineteen school districts in Delaware and the thirty-two high schools within them.  The goal of the vendor contracts would be to increase the role of wellness centers in schools.  The funding was already put in place in the FY2017 budget.  A few high schools wouldn’t begin these kind of contracts until FY2018 because they didn’t already have existing wellness centers in the schools.

I have grave concerns with how much DHSS wants to happen in our high schools.  I understand why the bid for this is coming out of DHSS, but this is an education matter.  I fully understand that some students may not have access to medical treatment so I am not explicitly against these types of centers in high-needs schools.  But the amount of private student data involved is astounding.  Under HIPAA, that is merely a consent for information to go out from a health provider to another entity.  Parents need to understand exactly what they are signing consent for.  Where this gets confusing is the differentiation between HIPAA and FERPA.  FERPA only applies to educational records.  The data from these health centers in our high schools would not fall under FERPA.  Or at least they shouldn’t.

There are several terms in the above picture that worry me.  “Prevention-oriented multidisciplinary health care”… I’m all for prevention, but prevention against what?  Where is the line drawn?  What if one of these multidisciplinary measures goes against a student’s religion?  What if the student is not aware of that but a parent becomes upset when they find out?  “Integration with primary care”… what does that even mean?  Integration would mean a data system cross-referencing the health information between a primary physician and the school-based health provider.  Does that information flow both ways?  Serious data privacy concerns here folks!

“The delivery of medical and mental health services”… If a student needs immediate treatment, is a school even equipped to act as a triage type unit?  Is that the eventual goal here?  In terms of mental health services, I have long thought it was a good idea for school districts to have psychiatrists or neurologists on hand for IEP meetings.  All too often, psychologists are used to determine “behavior” issues but a psychiatrist or neurologist would be able to give more explanation of what is going on neurologically when a student manifests disabilities.  A psychologist can’t prescribe medicine and as a result, they may not have up to date knowledge of what different medicines do and how they metabolize with the human body.

Students come into our schools with trauma.  Of that, no one seems to be in disagreement.  If families aren’t able to provide students with safe and supportive environments at home, then the school setting would be ideal for students to get the help they need to deal with those issues.  But my concern is this becoming available for ALL students eventually.  All too often parents are denied health information about their child on certain things when it comes to the existing wellness centers.  With this program increasing in scope like this, I can picture that becoming a much bigger issue.

In private practices, these types of services are not cheap.  But that is where the best in their fields tend to go.  With this plan, how many would leave existing private practices to come work in schools?  Not too many I am afraid.  As a result, we would most likely get younger, fresh out of college mental health providers without the experience.  They would get paid less and as a result an inequity would develop between students who come from stable and wealthier home environments and those who come from low-income or poverty families.  Those who come from the stable homes would most likely continue to go to private practices.

DPH is the Division of Public Health.  They would provide partial funding for this project.  But what happens when the project becomes mainstream?  All too often, our school districts become the financial bearer of state mandated programs.  Yes, the funding exists now, but what happens when it isn’t available?  Do they cut these programs out of schools entirely or do local school districts bear the financial burden for paying for these programs?

My first question: what is the School-Community Health of Michigan entity that appears to house school-based health information?  How secure is this data?  If one of the vendors chooses to implement the two years to develop their plan for data reporting, how safe is that data in the meantime?  Should all student risk assessments be standardized?  I would think students with disabilities, those coming from broken homes, or those dealing with poverty would tend to fall lower on a standardized scale as opposed to their peers.

I don’t mind a culture of health.  Lord knows we can be healthier in this country.  But when I see “How youth and parents would be involved in the “planning, operation, and promotion of the SBHC,” that seems like a lot of emphasis put on parents.  If these services are for high-needs students whose parents aren’t big on family engagement, this would result in parents of regular students doing the pushing for these programs.  Will they want to do that if it isn’t for their own child?  “Potential partners and key stakeholders”… as defined by who?  And as we all know, data flows to “partners” quite a bit with education records.  Would parents be given consent forms to send their child’s medical data to entities who really don’t need that information at all?  It mentions HIPAA here, but this is a very slippery slope.  I need a lot more information here.  What is a “diversified funding base”?  Since, invariably, all of this would be paid for by the taxpayers of Delaware, will they really want to pay for other students health services?  We already do, to some extent, but this would increase those costs.

I’m sorry, but did that really say “if the SBHC intends to be a Title X/family planning provider”?  For those who may not be familiar with Title X, the U.S. Department of Health and Human Services describes this program on their website:

Family planning centers offer a broad range of FDA-approved contraceptive methods and related counseling; as well as breast and cervical cancer screening; pregnancy testing and counseling; screening and treatment for sexually transmitted infections (STIs); HIV testing; and other patient education and referrals.

I hate to even bring this up, but if this could in any way lead to abortions being provided in schools that would cause a nuclear war between parents and schools.  No matter what your views on abortion might be, I would tend to think the school would be the last place anything like that should happen.  For that matter, the various “screenings” allowed under Title X could lead to serious contention as well.  For the “5 performance measures for the basis of evaluation”, based on federal guidance I imagine, does that mean every single school-based health center would be required to perform these five measures?  Chlamydia testing can be done by urine samples for both males and females, but sometimes they are performed for females as vaginal swabs.  I would hope that isn’t the method being proposed in this contract.  With all seriousness, I do know chlamydia is a very serious sexually transmitted disease and among the most common.  I don’t know if school-based health centers currently screen or test for chlamydia.  If anyone has information on this, please let me know.  I reached out to a few people who were shocked this would be included in this.

Once again, my biggest concerns with all this surround student data.  This goes way beyond my concerns with existing student data.  Parents should seek answers for this.  I know I will be!  Please read the entire RFP, seen below.  I need to know your thoughts on this.  This is very big and I don’t feel Delaware citizens are even aware of this going on without our knowledge.  The transparency on something of this scope has obviously not been present.  Please share this with everyone you know in Delaware.  Get feedback from your friends or those in the medial profession.  Is this too much?  I have seen a lot of “futurist” lingo talking about how our schools will become “community schools” in the truest sense of the word based on things like this coming to fruition.  Does the term “the whole child” include aspects that will eventually take authority away from parents when it comes to their children’s health?  How much will parents be able to opt out of these programs?

Christina Board of Education Will Review Superintendent Spending Tonight

The Christina School District Board of Education will review the amount of spending their Superintendent can spend before they have to get board approval at their monthly meeting tonight.  The current limit is $20,000.  Previously, it had been $50,000 but after their second failed referendum attempt in 2015, the board lowered the amount.

$50,000 is a key figure with Delaware Superintendents.  In Delaware code, any contract of $50,000 or more has to go through the request for proposal process in the state.  Many school districts circumvent this by having contracts for $49,000-$49,999.  These kind of budgets can be controversial.  School boards lose some power when the districts write those kind of vendor contracts.

As well, the board is reviewing this type of spending for school principals with another proposal to raise that amount without a signature from $10,000 to $25,000.

With many citizens in Delaware demanding greater transparency of school district funding, this could be seen by those advocates as more continuous evaporation of schools and districts not giving crucial financial information to the public.

The board also has an item on their agenda, if approved, would give the board more ability to participate in legislation and regulations that could affect the school district.  If implemented, this would give a board member the ability to go to Senate and House Education Committee meetings as well as State Board of Education meetings and give public comment on behalf of the board.  The policy would also mandate that any board member speaking about education policy would have to state in public these are individual thoughts and not reflective of the Christina School District of Board of Education.  For the past two years, the board has declined to join the Delaware School Boards Association which usually has their own representative at these types of meetings.

The board will also discuss the upcoming implementation of the Every Student Succeeds Act and what that could mean for the district.  I highly recommend board members participate and comment on this confusing legislation and make sure their voice is heard.

Is The Delaware DOE Being Taken Over By Corporations? A Multi-Vendor Contract Bid For 9 Different Categories?

I have seen some really crazy requests for proposals coming out of the Delaware Department of Education, but this one takes the cake!  This latest RFP is a multi-vendor solicitation for nine different areas of education.  I would almost say it looks like vendors will completely take over the Department of Education looking at this!  While that probably isn’t the case, I have often wondered why I can’t find contracts for certain vendors at the Delaware DOE.  My guess is these kinds of multi-purpose vendor bids have gone out before.  Which is why I have never seen a DOE contract with the Rodel Foundation or the Vision Network.

But this is huge.  Are they preparing for the Every Student Succeeds Act?  While the law is meant to limit federal interference in how states carry out the law, it certainly looks like it is a cash cow for corporations to come in at lightning speed before the ink is dry on the regulations.  Maybe if the Delaware DOE hired more educators, they wouldn’t need all these so-called “experts” in education.  Delaware education has not gotten any better with all these cash in the trash consultants and vendors.

Our General Assembly needs to get control of the DOE.  They are destroying what is good about education for our children, one day at a time.  Piece by piece, bit by bit.  And the transparency around their actions seems to be getting murkier by the week.  But make no mistake, the entire DOE is led by one man: Jack Markell.  He is behind every single decision that goes on there.  He is so invested, politically and personally, in corporate education reform that he is unable to tell the difference between reality and wishful thinking.  He is beyond being able to reason with.  He lives and breathes education, but from a corporate perspective, not an educator one.

There is far too much going on at the Delaware DOE these days.  Between ESSA meetings that I have no doubt have predetermined outcomes already in the works, their Special Education Strategic Plan (which I will have more to say about soon with the Paul Herdman selected guy running this), the charter-district funding fight, the charter school performance frameworks, Teacher-Leader pilots with very questionable transparency, getting ESEA flex waivers without clearly stating what they were applying for and not having the advisory committee required by law to go along with that, ongoing concerns about the upcoming Social Studies and Science state assessments, their complete and total pimping of the Pathways to Prosperity program, their inability to understand and listen to true stakeholder input, allowing Rodel to influence their every move, and willful defiance of the will and intent of the Delaware General Assembly.

This contract confirms my worst fears about this Department.  They spend hundreds of millions of dollars every year in contracts to vendors.  Money that should go into classrooms.  Money that should keep classroom sizes down.  Money that  give basic special education to students in Kindergarten to 3rd grade.  Money that should give more resources to low-income and poverty-stricken children.  Money that should go to school improvements and Capital funding.  Instead they are giving it away to companies.

Delaware DOE Has No Desire To Dump Common Core Or The Smarter Balanced Assessment

Last week, the United States House of Representatives overwhelmingly passed the Every Student Succeeds Act.  The US Senate will most likely vote on the bill this week and it is expected President Obama will sign the bill.  This will get rid of the No Child Left Behind mandates imposed on all the states.  It gives states more control.  It explicitly says states can come up with own state standards and they do not have to be tied to Common Core.  In Delaware, I see absolutely no indication of Governor Markell or the Delaware Department of Education dumping Common Core or it’s bastard offspring, the Smarter Balanced Assessment.

On October 27th, the DOE submitted a proposal for contract bids on an Early Literacy Initiative.  The bidding on this closed last Friday, 12/4.  The contract calls for a vendor to go into four Delaware schools, three traditional district schools and one charter school.  From the Request for Proposal:

Delaware and literacy rates for the most at-risk students have never been something to brag about.  I fully support all children learning to read, but if the motivation is so they do better on the Smarter Balanced Assessment, I have serious issues with that.  I don’t think increased “rigor” is going to help the students whose needs are not being met.  For those who want to bash me for this, it is all designed for increased proficiency on the Smarter Balanced Assessment.  Why?  Good question.  Governor Markell was the one who wants students with disabilities to go from 19% proficiency on SBAC to 59% in six years.  Like that rigor rubber band isn’t going to snap!  This is what standards-based IEPs are all about, and anyone saying they aren’t is either lying or is unaware of the true motivation.

Which schools will be a part of this experiment?  Are these current priority or focus schools?  The DOE should really give more information on these schools so the vendor can know exactly what they are getting into.  There is a huge difference between MOT Charter School and East Side, or Warner Elementary and Hartly Elementary.  Are these schools the DOE is going to pick for this even aware of what is coming with this contract?  And who were the bidders?

I am very familiar with four of these bidders: American Institutes for Research (AIR), Public Consulting Group (PCG), Amplify, and University of Delaware.  But 95 Percent Group and Institute on Community Integration (ICI)?  Never heard of them.  I checked out 95 Percent Group’s website and I always get nervous when I see only three people listed as employees for a company like this.  I’m sure they have more, or maybe they don’t.  The Institute on Community Integration is through the University of Minnesota.  Whereas 95 Percent Group has a small staff listed, ICI has tons of staff listed on their website!  This happens with university programs like this.  I hate to see AIR and PCG get even more involved in any aspect of Delaware education.  It is very sad that the DOE has more faith in these companies than they do in our own schools and teachers.  But since someone has to be the mediator between these companies and all our schools, it helps to make their existence even more important than it really is.

I have to ask though, what the hell are we even doing anymore?  All of these companies have one goal when they take on these state vendor roles: increasing the scores on the state assessments.  Whether they reach their goal or not, it is a faulty measure of success because state assessments do not provide an accurate assumption of student success.  By driving students to do well on these tests, all they are getting paid for is essentially helping teachers teach to the test.  That isn’t education.  It is a false narrative written by folks like Governor Jack Markell.  We need to stop reading this story.  We need to demand our legislators strip the DOE of spending our taxpayers funds for “cash in the trash” programs like this.  Every time the DOE signs a contract like this, with some contracts never seeing the light of day, we allow the DOE to continue this practice.  Most of us aren’t even aware of this.  Enough is enough…

DOE Getting Vendor To Make More Students With Disabilities Proficent On Smarter Balanced By 3rd Grade

Another request for proposal came out from the Delaware Department of Education at the end of October.  This one is for the Delaware Early Learning Literacy.  You can read the whole below document, and what they want this vendor to do that they clearly can’t do themselves.  But what it boils down to is this part from the Request for Proposal:

Decreasing the percent of students with disabilities in grade 3 that score below proficiency on the statewide assessment.

It always comes back to the same thing: Smarter Balanced.  The damn test…

Science & Social Studies State Assessments Up For Bids By Delaware DOE For 5 1/2 Year Contract With No General Assembly Legislation

The Delaware DOE wants to remove the DCAS Social Studies and Science State Standardized Assessments and have new ones implemented by the 2016-2017 school year.  They currently have a Request for Proposal (RFP) with final bids due by 11/30/15.  You have to love this part of the bid proposal:

The initial term of the resulting Contract(s) will be from the Contract’s effective date, on or about December 31, 2015, through June 30, 2021. The DDOE reserves the right to extend any contract awarded as a result of this Competitive Sealed Proposal (CSP) for as many as five additional annual contracts if it is deemed to be in the best interest of the State of Delaware.

I imagine these new tests will be “more aligned with the Common Core State Standards” and the RFP already states these tests will be a part of the Delaware School Success Framework.  So where does the DOE have the authority to do this?  And where is the oversight?  Look no further than this part of the proposal:

Funding for Contract(s) resulting from this Competitive Sealed Proposal (CSP) is contingent upon approval by the Delaware General Assembly each year of appropriations, limitations, or other expenditure authority.

The DOE estimates the “winner” will be announced around 12/18/15 with a start date of 12/31/15.  While this bid proposal was created on 9/29/15, note at the bottom of page 2 and page 3 what the accountability measures are for proficiency.  Yes, the old participation rate multiplier is in full effect on here even though the Accountability Framework Working Group voted against it and the State Board has yet to make a decision on this.  Couldn’t that affect the bid process somewhat?

And what is the DOE requiring for these tests from a vendor?

require students to demonstrate a range of higher-order, analytical thinking and performance skills in reading, writing, and research based on the depth and complexity of Delaware Social Studies Standards, Common Core State Standards for Literacy in History/Social Studies (grades 6-10 only) and/or Next Generation Science Standards allowing robust information to be gathered for students with varied levels of achievement. A significant portion of total score points come from items that demonstrate a deeper level of knowledge (e.g., represent the high complexity levels designated by taxonomies of cognitive demand).

And which students will be taking these tests?  Currently the DCAS Science assessments are for grades 5,8, and 10 and the DCAS Social Studies is grades 4th and 7th with a High School End of Course for U.S. History.  By the 2019-2020 school year, these tests will be for all students from 3rd through 10th grade, in both Science and Social Studies.

Now if the 147th General Assembly had to approve the Smarter Balanced Assessment as the State Standardized Assessment and the bids for this are due while the General Assembly is out of session (like they did with Smarter Balanced), is this even allowed?  Some legislators in the 147th General Assembly stated they voted yes for the Smarter Balanced legislation (House Bill 334) because Mark Murphy and the DOE already bought it.  Can the 148th General Assembly prevent the very same mistake from happening again before a contract is signed and sealed?  Especially when the plan is to have even more students taking these assessments?

Updated: I read through the text of House Bill 334, which allowed the Smarter Balanced invasion in Delaware (even though  the DOE already signed a contract with American Institutes for Research to be the test vendor and joined the Smarter Balanced Assessment Consortium).  For Science and Social Studies, House Bill 334 states the following:

(c) The assessments referred to in subsection (b) of this section shall measure achievement in readingEnglish language arts and mathematics for students in a minimum of grades 3 through 8 and high school, provided additional grades may be added by the Department. Science and social studies shall be assessed for students at least once in the elementary grades, at least once in the middle grades, and at least once in high school.

It looks like the DOE is taking the “at least once” and running with it.
