Cape Henlopen Under Fire For Failure To Report Employee To State Police

Rob Petree with Delaware 105.9 reported Cape Henlopen School District lied about an offensive touching incident three years ago.

The incident, where an employee grabbed a female student’s pants to see her rear, was shocking enough.

“…and before she knew it he had stood up, grabbed the back of her pants, pulled them away from her body to get a look at her rear-end.”

But the school district told the student’s parent they reported it to the Delaware State Police.  Turns out they never did.

“The alleged incident was not reported to the Delaware State Police in May 2015 and handled by the Administration at the school,” said Sgt. Richard Bratz, Director of Public Information for Delaware State Police. “The school advised this did not rise to the level of a mandatory school report and that the school district resolved it.”

If the man was still at the school years later it doesn’t sound like the district “resolved” anything.  They made the employee work after hours when students were not present.  They openly lied to a news organization about reporting it to the police.  How is that okay?  In a way, this makes the original offense even worse for the victim.  It is saying “we don’t care, we stand by our employees”.  It is not okay for an adult to do that.  It is not okay for the same adult to walk around with racist comments and innuendos.

The response from the district sounds like one I’ve heard before when all of a sudden they are in the hot seat:

The Cape Henlopen School District said “due to the nature of the allegations made by the family and privacy rights of individuals involved, the district is not able to provide specific comments about the concerns.”

Yup, time for the game of say nothing, do nothing.  Sorry, they should have spoken loud and clear three years ago!  Should Superintendent Robert Fulton resign over this?  Any adult in a school is a person of trust.  By keeping an employee that does what he did, lying about how you reported it, and failing to protect students, Fulton allowed this erosion of trust.

Video Of Disabled Student Getting Beat Up In Caesar Rodney High School Adds To C.R.’s Very Bad Week

On Tuesday, a student with disabilities was beat up very badly in the Caesar Rodney High School cafeteria.  According to WDEL’s Amy Cherry, this was not related to the racial slur associated with the high school mascot that shook the Caesar Rodney community this week.

The boy’s parents contacted their advocate, Diane Eastburn, because of the punishment meted out to their son who was massively beat up.  He was charged by the school with “offensive touching” even though he is not seen on the video punching the other student.  The word “bitch” was thrown around prior to the fight.  The disabled student received two days of in-school suspension but his parents do not feel the punishment should have been given to their child since he wasn’t fighting.  The parents and Eastburn contacted WDEL yesterday.  In fairness, I sent Eastburn to WDEL because I was uncomfortable posting the video with minors on it.  The video is very graphic as described by Cherry:

The student was repeatedly being punched in the back of the head as he used his hands to cover his head. The victim student suffered bumps and bruises to his head and face in the assault.

This has Eastburn wondering what is going on at Caesar Rodney High School since these two unrelated incidents happened in the same week:

“There seems to be an underlying hostility in that building,” alleged Eastburn. “And if they’re having problems they need to address it quickly. To be quite honest, they can’t afford not to.  If they start having fights like this, someone’s going to get hurt or worse.  These are lawsuits waiting to happen if they don’t start dealing with the undercurrent in that building.”

These are questions the district are going to have to look at.  I sincerely hope the disabled child does not have a concussion or any lasting damage done in this brutal assault.  I don’t think any student who is attacked should get a punishment like that, whether they are disabled or not.  If words are said, let the punishment fit that category.  But using a poor choice of words is not the same thing as offensive touching in any world.

Updated, 3:15pm: Caesar Rodney School District Superintendent Dr. Kevin Fitzgerald issued the following statement regarding this incident on the district website-

STATEMENT FROM DR. FITZGERALD REGARDING CRHS CAFETERIA INCIDENT

“Recently a fight that previously took place in the Caesar Rodney High School cafeteria has been posted to the internet.  This situation in no way is related to the recent mascot post. After an investigation by the school administration and the Delaware State Police, disciplinary action was taken and an arrest was made.  Fights of this nature, while rare are unacceptable and are not tolerated in Caesar Rodney. The District will continue to work hard to insure the safety of our students.”

 

 

Glitch In DOE Reporting Fails To Show School Offenses & Crimes Data For Charter School of Wilmington, Delaware College Prep, & Delaware Military Academy

How about those apples? I actually found a huge technicality in the DOE reporting system for bullying and the DOE fixed it in record time.  Contrary to popular belief, things at the Red Clay charter schools are NOT as rosy as the past couple years of bullying and discipline reports provided by the Delaware Department of Education would have you believe.  I was very puzzled when I saw, for two years in a row, none of these three charters had their individual reports come up on the DOE School profiles website.  I emailed John Sadowski, the Program Manager for Climate and Discipline at the DOE this morning and advised him of this.  As of 12 noon, the reports are now available.

I’m not sure what happened, and it didn’t change the Annual bullying report I posted this morning, but it does show some things parents would not have seen before this fix.  I would like to believe this happened because of the odd nature of Charter School of Wilmington, Delaware College Prep and Delaware Military Academy being the only charters in the state authorized by a school district.  In this case, the Red Clay Consolidated School District.

Using Delaware College Prep as an example, this is the only information parents could see for them on the School Profiles page of the DOE website:

But before 12 noon today, it didn’t come up for the three Red Clay charters while it did for every other public school in the state.  I put up both the reports for Red Clay, before and after so you can see the difference.

So what got me all interested in Red Clay charters and these reports?  It had a lot to do with this article.  I knew the student was suspended for many days over suspected drug activity. I wanted to be sure Charter School of Wilmington reported it right to the state since that was part of the issues at the time. I believe they did, because it shows 20 students were suspended from the school for a total of 118 days.

I don’t believe this was an intentional mistake on the DOE’s part, but oversight and making sure all the reports came up would have been prudent. I’m glad they fixed it though and parents can see what actually happens in terms of reportable offenses at these three schools.

With the current issues Delaware College Prep is going through, knowing they have had 18 fights and a violent felony might be something the Red Clay Consolidated Board of Education may want to know about. Although I am curious what the two Delaware DOE offenses are for Delaware Military Academy with nothing checked off in the sections for that category.  Maybe they aren’t done fixing it…
