Exclusive: Public Integrity Commission Slams Odyssey’s Board; Potential McGuiness Ties To AHEPA Creates Huge Conflicts of Interest

On April 2nd, the Delaware Public Integrity Commission wrote a letter to the Odyssey Charter School Board of Directors which showcased a plethora of financial improprieties, conflicts of interest, and co-mingled interests involving their board and the American Hellenic Educational Progressive Association (AHEPA).  The Odyssey Board of Directors has nine members, five of which belong to AHEPA.  Currently, Odyssey is beginning a formal review by the Delaware Department of Education after the State Board of Education voted to place the charter school under review last week.

Remember last year when Kathy McGuiness won the election for State Auditor?  Remember all the public smearing of Kathleen Davies that the News Journal unabashedly did?  Remember WHERE they got all that information?  Remember McGuiness won the primary against Davies and Dennis Williams but probably wouldn’t have without the tarnishing of Davies?  Who was the primary force behind Davies ousting?  None other than Andrena Burd.  She was the one who was instrumental in Davies very long leave of absence and subsequent unemployment hearings.  Eventually, Davies was reinstated at the Auditor of Accounts where she currently works.

Not long after the primary, Burd managed to find herself at a cushy auditing job over at Delaware State University where McGuiness just happened to be on their board at the time.  It turns out loyalty is very rewarding for Andrena Burd.  One former employee had A LOT to say about her recent re-hiring at the Auditor of Accounts office.  And for the record, why does Kathleen McGuiness have to make such a big deal with these swearing-in ceremonies?  Is this just practice for her dream to become the Governor of Delaware?  Or does she have her eyes set on an even bigger prize?  In any event, let’s hear what the former AOA employee has to say!

Well, it seems Ms. Burd has landed back in the AOA and with a promotion at that.  All the other folks have left because of the stuff that went down.  But Burd stayed out of the fray till it was over and now McGuiness has hired her back.  Hmm… Probably to work on getting Davies fired again.  Burd is bagging and boasting.

Burd, who was discredited by the Unemployment Insurance officer and the MERB did not seem to faze McGimick too much.  After her testimony that she thought Davies violated standards it turned out as a complete embarrassment for Burd as she did not know as much as she portrayed.  She has no morals or ethics.

How much does McGimick owe Burd for getting her elected to the AOA?  A new position?  A promotion?  And this happened after Tammy Smith left the office.  Burd would probably have not gotten that position if Smith did not leave.  Burd set up Smith, Tatman, Judy, and others.  Glad I got out in time!!!  She got promoted while all others left.  A pretty good assessment of the situation.

How many individuals have left since McGuiness took over?  Quite a few and more to follow.

As for McGuiness’ campaign promise of more transparency coming from the Auditor of Accounts office, it seems she is the sole force on the office’s website.  Even under former State Auditor Tom Wagner you could see other names on there.  But this is McG’s show and it always has been.  I have yet to see ANY investigative audits coming out of the office but this doesn’t shock me.  I’ve heard tales of some crazy stuff going on there that would make the office seem as corrupt as ever but that is a story for another day.

Last week, the News Journal reported Kathleen Davies won her Merit Employee Review Board appeal hearing.  She will be reinstated at the Auditor of Accounts office after a two and a half-year ordeal.  She ran for State Auditor but lost to opponent Kathy McGuiness in the September 6th Primary.  McGuiness won the General Election so the two women will soon be working in the same building.

In eight days, Delaware will elect a new State Auditor.  It is between Kathy McGuiness (Democrat) and James Spadola (Republican).  While McGuiness’ has vowed the office would be completely independent, as has Spadola, the lingering plotline of the destruction of Kathleen Davies still has questions.  One of those questions surrounds the destination of one of the architects of Davies’ ouster at the Auditor of Accounts office (AOA).

On September 7th, I filed a Freedom of Information Act complaint against the Delaware Auditor of Accounts office.  Even though I did receive the documentation for my original FOIA request regarding a contract that office entered into with Grant Thornton, it came very late.  In fact, it came the day after a highly contested primary for the State Auditor position.  But my FOIA complaint dealt with what I felt were illegal and unethical issues coming out of AOA.

John Fluharty.  He who suffers from that unique Delaware ailment called sitting in a job and getting paid on the taxpayer dime and doing nothing.  For someone who pretends to be a Republican, he sure does like to get involved in Democrat power games.

In a close race, Kathy McGuiness won the Democrat Primary for State Auditor this evening.  John Fluharty, State Auditor Tom Wagner’s Deputy, was behind the leaks about Kathleen Davies to the News Journal and other media outlets in Delaware.  The News Journal reporter, Jessica Bies, relished in writing about this sordid mess.  So much so she forgot what Journalism 101 even looks like and did the bidding of her masters to smear Davies no matter what it takes.  Because that is the true and ugly side of the Delaware Way.

Tonight, Fluharty gave the following statement about the McGuiness win to the News Journal:

John Fluharty, who works for Wagner and is the former executive director for the Delaware Republican Party, said: “Democratic voters sent a clear message to Kathleen Davies tonight.” 

“Don’t go away mad, just go away.” 

John Fluharty is the cockiest and most arrogant son of a bitch I’ve run across in Delaware.  Enjoy your moment in the sun Fluharty.  I can promise you it won’t last long.

What Fluharty seems to forget is Davies could return to that office as Tom Wagner’s second-in-command after the next Merit Employee Review Board hearing.

I am far from done with Mr. Fluharty.  Along with his co-conspirators, Andrena Burd and Tammy Smith, they attempted to destroy Kathleen Davies.  They didn’t succeed.  The results of the Primary have no bearing on the heart and soul of Kathleen Davies.  She is still an awesome woman and you didn’t break her.  Despite the best efforts of the Fluharty Gang along with the News Journal, Davies was not trounced.  It was a close win for McGuiness in a three-way race.

It is obvious, given Tammy Smith’s statement on Facebook five days ago, along with the same language conveyed from McGuiness supporter Mitch Crane to myself back in June, the office was talking with the McGuiness camp.  What Smith said was near verbatim to what Crane said he “heard” about that office.  I even have an email where Crane and Fluharty discussed getting together for lunch.  It doesn’t take a rocket scientist to see you would tell anyone fantastical stories to keep your job.

Fluharty is a state employee.  He said this about someone knowing full well there are still hearings going on about her unwarranted dismissal.  Together with Smith’s Facebook rant the other day, he is openly and publicly saying screw you to any state rules in talking about an office personnel matter.  He thinks he can get away with whatever he wants.  But let me ask you this Fluharty.  If McGuiness wins the General Election, do you really think you have any shot in Hell of remaining in that office?  Do you think the “life-long Democrat” will keep a slimy Republican like yourself?  If Spadola wins, by the time I have my fun with you between now and the General Election, would he want someone as toxic as you in that office?  Either way, you will be gone.  Toast.

You might be thinking you won some war and I have no doubt you and your cronies in the office will be celebrating tomorrow.  It will be a short-lived victory.  I can promise you that.  You are just as expendable as you made Davies.  Along with Burd and Smith.

Only one candidate in the State Auditor race has the tenacity, patience, grit, resolve, willingness, and heart to perform the role of State Auditor.  She has soul and a love for auditing second to none.  She has been put through the wringer by those who didn’t want her to do her job.  But she has come through that ordeal a stronger and better person.  For that reason alone Kathleen Davies deserves your vote.

Imagine, one day, years from now, when her State Auditor days are a thing of the past.  When Park City decides to reach for the brass ring.  When she decides to run for Governor of Delaware.  This is what Democrat voters could ultimately decide on September 6th if they collectively vote wrong.

If you thought Jack Markell was bad.  If you thought John Carney was bad.  You haven’t seen ANYTHING until you’ve seen Park City leading The First State in some kind of fresh hell I couldn’t imagine on my very worst day.  In that kind of Hellaware, LLCs would be more important than people.  She would still be talking about her $1 million in change orders when she was on Rehoboth City Council.  Her days at the State Auditor’s office would be as hazy as the water next to an old DuPont plant.

To the union members in Delaware, I say this: many of you endorsed McGuiness.  She wouldn’t even march with you in solidarity today.  She opted to wear her own campaign regalia and walk on the sidewalks.  You put your reputation and political muscle on the line for her and she couldn’t even walk with you.  What does that say?  This same woman who doesn’t know the difference between ABC and AFL-CIO.  She used you.  Don’t give her the satisfaction of giving her your vote. I’m sure your leadership would love for you to push that button.  She is pushing ALL your buttons and will screw you over.  You can take that to the bank.  She will not protect you against Right To Work in the future any more than she pretended to on that nine degree day last January.  You can trust your Marvel or you can trust me.  Your choice.

Voters need to be careful what kind of doors they open when they push that person’s name on the ballot.  Be smart.  Vote for Kathleen Davies for State Auditor on Thursday.  Not only will you see a return to more fiscal transparency in Delaware but you will also be getting the most qualified candidate ever to be State Auditor.  Ignore all the pictures.  They don’t mean a thing.  What matters is quality, not quantity.  What matters is getting the job done, not pretending you are not beholden to others when you know you are.  What matters is keeping the power in check, not checking to make sure the power isn’t held accountable.

With four days until the Delaware 2018 Primary, the State Auditor’s race is gaining a TON of attraction this year.  While some may suggest McGuiness has this locked up, I beg to differ.  There are two scenarios that will play out.  Whoever wins the Primary will determine who wins the General Election in November.

The Delaware State Auditor race has been one of the hottest tickets of the election season.  There are many reasons for this in what is usually a quiet race.  The biggest factor is long-time State Auditor Tom Wagner not running after a 29 year stint in office.  Kathleen Davies served as Tom Wagner’s second-in-command for many years and announced her run to take over Tom Wagner’s seat.  Davies faces her Democrat contenders Kathy McGuiness and Dennis Williams in the Primary next Thursday, September 6th.  The winner of the Primary will face Republican James Spadola for the General Election.

Kathleen Davies just released the agreement for the Grant Thornton contract.  The contract was commissioned by Delaware State Auditor Tom Wagner to look into Kathleen Davies, who many feel was ousted from Wagner’s office for doing quality audit investigations. The contract is a bigger bomb than the report because it proves the report is bogus.

Kathleen Davies, a Democrat candidate for Delaware State Auditor, issued an official press release today about the very controversial News Journal article that appeared online and in print over the past couple of weeks.  This answers many questions I’ve had and confirms many suspicions I’ve harbored over this matter.

In a letter to Delaware Attorney General Matt Denn, State Representatives John Kowalko and Kim Williams are urging Denn to investigate the controversial leak from the Auditor of Accounts office.  On August 8th, the News Journal “obtained” a report from AOA regarding a personnel matter with Kathleen Davies.  While the validity of the report has yet to be determined, especially since it wasn’t even used in Davies unemployment hearing, the report was leaked from AOA.

The News Journal based an entire article, online and in print, on the report.  I find it ironic that a cabal of folks at AOA, who falsely went after Davies over sending a draft copy of an audit to Kim Williams (which was found to be perfectly okay), seem to think it is okay to send out a confidential employee report that very same office may have had the ability to edit themselves.  Talk about sheer hypocrisy!  Political motivation during an election?  You better believe it!  Reports have come out of that office where employees would spend their time on political campaigns in the last election.  I don’t mind any citizen helping out with elections and all that, but not while you are on the clock for the state!

Last week, News Journal reporter Jessica Bies came out with an article about a confidential report that the News Journal “obtained”.  The article was rife with speculation and hearsay based on a report commissioned by State Auditor Tom Wagner concerning Kathleen Davies.  That article appeared in print today.  It looks like something you would see in a bargain-basement tabloid at a grocery store.

Editor’s Note: I was going through my drafts folder today and I found this little gem from June 20th, 2016.  I wasn’t able to fully verify the reason Kathleen Davies was ousted from State Auditor Tom Wagner’s office.  Nobody really knew except Tom Wagner and he wasn’t talking.  I had my suspicions.  Turns out they were just part of the reason.  As Davies continues to get wrongly persecuted by the News Journal during an election, I thought this would be an opportune time to publish this “lost in the drafts folder” article:

For the past couple years, Kathleen Davies has been very busy.  As the Chief Administrative Auditor, she had her hands full with education audits, specifically those dealing with charter schools.  She was in charge of the investigations for Academy of Dover, Family Foundations Academy, Providence Creek Academy, and the recent September 30th Count investigation.  Recently, however, there have been two glaring omissions from State Auditor Tom Wagner’s website: Kathleen Davies and the September 30th Count report.  Where did they go?  Are the two connected?

This is Delaware.  Of course they are.  Word on the street is the Delaware Department of Education didn’t like the September 30th report, even though they requested it.  When they asked Davies to make changes, she refused.  This caused an impasse, and the result… Davies and the report are gone.  Apparently the DOE’s influence now stretches across State of Delaware Departments.  All the way to the Auditor’s office.  Ironically, their central offices are both located in the Townsend Building.
